TERMS AND CONDITIONS
You are engaging me to provide you with integrative and East Asian Medicine Telehealth and/or acupuncture and East Asian Medicine services. Please review the following before we meet. If you have any questions, I am happy to discuss them during our session or via secure email. Please email me to request access to an encrypted email.
I (Dr. Lee Hullender Rubin, DAOM, MS, LAc) hold doctorate and master of science degrees in Acupuncture and East Asian Medicine*, and am a licensed acupuncturist in the states of Oregon, Washington, and California. This means I have had more than 6,000 hours (7.5 years)of education that included substantial supervised clinical training. I am not a physician, psychologist, or therapist and cannot provide such services; I will make a referral if needed. My services should not be used as a substitute for medical care.
Email is welcome. However, I will address most issues within the regularly scheduled sessions. In general, I can respond to an email within one business day. In the event of a medical emergency or emergency involving a threat to your safety or the safety of others, please call 911 or the appropriate emergency service to request assistance.
FEE FOR SERVICE:
To make an appointment, you will be required to provide a form of payment to schedule, however, you will not be charged until the day of your appointment. The fees charged are for consults and treatments provided and will be collected at the time of your appointment. The fees are comparable to those of other specialists with similar qualifications. The fee schedule may be updated at any time without written notice. The current fee schedule is:
Telehalth only East Asian Medicine services (herbal consults, integrative medicine support, nutrition and lifestyle support, etc) :

CANCELLATION POLICY:
If you need to cancel or reschedule an appointment, I need a FULL 24 HOURS NOTICE to change your appointment without charge. Any appointments canceled or rescheduled without 24 hours’ notice will be charged $60. Please realize I have reserved this time for you and that another person in need of care will be able to have time with the provider when 24 hours’ notice is given. I will wait 15 minutes in the video visit room for you to arrive for all telehealth appointments. INSURANCE POLICY:
I have no payment agreements with your insurance company. Insurance benefits are a matter between you and your insurance company. I will be happy to supply you with any information you may need to assist you in procuring payment of your medical claims. Submission of medical insurance claims is the responsibility of the insured.
ACUPUNCTURE POLICY:
Acupuncture services are available in person at Rosefinch Health offices in Portland, OR only. Unfortunately, home visits are not provided. All acupuncture providers are licensed by the state of Oregon and provide treatments in accordance within the scope of practice. Acupuncturists at Rosefinch Health follow safety protocols, are vaccinated for SARS CoV-2, and adhere to clean needle technique guidelines, and those directed by the Multnomah Co. Department of Health, and state of Oregon.
Acupuncture therapy may reduce pain, stress, anxiety, chemotherapy-related fatigue, peripheral neuropathy, side effects from aromatase inhibitors, and support fertility, digestion, menstrual regularity, and sleep. You understand acupuncture therapy is a medical treatment that is generally safe when provided by a licensed acupuncturist but does have some risks. The risks of any procedure will be described to you prior to treatment, and your consent both written and verbal will be requested. You may withdraw your consent at any time.
Other therapies that may be provided alongside acupuncture are moxibustion, gua sha (dermal friction), tui na (medical massage), thermal therapy, laser acupuncture therapy, transcutaneous electro acupuncture stimulation (TEAS), herbal therapy, nutritional supplementation, dietary modifications, lifestyle modifications, fertility coaching, microneedling, and bio-light therapy.
TELEHEALTH POLICY:
To better serve the needs of patients, our consulting services may be available by telehealth (two-way interactive video communication and electronic transmission). This consent explains telehealth care. If you have any questions, please ask your provider.
You understand that you may be evaluated and treated via telehealth and agree to the following:
1. Telehealth Services: Telehealth involves transmission of video or digital photographs of you, and/or details of your health (“Transmitted Data”). All Transmitted Data is sent via electronic means to third party providers to facilitate health care services. You understand that:
a) Telehealth is different from traditional care in that we do not meet physically in person;
b) You will be informed of any additional personnel that are to be present, seen or unseen, during the encounter. You must inform me of any person other than you who is present. You have the right to exclude anyone from either location;
c) You have the right to refuse or stop participation in Telehealth services at any time and request an in-person appointment; however, equivalent in-person services might not be available at the same location or time as Telehealth services, or at all;
d) You have the right to follow-up with me as necessary with questions or concerns;
e) Benefits of Telehealth include that you and I can continue health care services when an in-person appointment is not possible or is inconvenient. I can also visualize some of your environment. Telehealth may also minimize exposure to illness;
f) There are also risks involved in Telehealth including, without limitation, losing the ability to; a) perform aspects of a physical examination (for example listening to your heart and lungs or verifying vital signs); and b) read physical or vocal cues/tones, and facial expressions;
g) Additionally, technical issues may disrupt the visit. There are also risks to preserving confidentiality including the risk that communications may be overheard; and that communications may be accessed by unknown third parties;
h) You shall have to access to all medical information resulting from the Telehealth services as provided by applicable law for patient access to medical records.
2. Confidentiality: All confidentiality protections required by law or regulation will apply to your care. Although confidentiality extends to communications by text, email, telephone, videoconference and other electronic means, I cannot guarantee that those communications will be kept confidential and/or that a third party may not gain access to such communications. With electronic communication, there is always a risk that communications may be compromised, unsecured, and/or accessed by a third party. To help maintain confidentiality when engaging in electronic health services, it is important that all sessions be conducted in a confidential place. This means that you agree to participate in Telehealth only while in a room or area where other people are not present and cannot overhear the conversation. Do not have sessions in public places. Sessions may not be recorded, and you must seek written permission before recording any portion of the session and/or posting any portion of sessions.
3. Emergencies: Telehealth is not appropriate if you are experiencing an emergent health care situation. If am experiencing an emergency, you understand that it is your responsibility to immediately call 911. If an emergency develops during Telehealth services, you understand that it is your responsibility to immediately inform me, call 911 and stay connected with me (if possible) until help arrives.
You have read and agree to the terms in the Telehealth Consent. You understand that Telehealth is not a substitute for in-person health care services. You understand that Telehealth is not appropriate if you are experiencing a crisis or having suicidal or homicidal thoughts. In case of emergency situations, you will contact 911.
TELEHEALTH DISCLAIMER
You understand that I am not an employee, agent, psychotherapist, accountant, nutritionist, psychologist, or other licensed or a registered professional outside of the states of Oregon, Washington, or California. I will NOT act as a therapist providing psychoanalysis, psychological counseling or behavioral therapy, or any similar mode of therapy.
You understand that I will not diagnose, treat or cure any disease, condition or other physical or mental ailment of the human body.
You understand if you experience any such issues, you should see your registered physician or other practitioner.
You understand that the information I may provide is NOT medical or nursing advice and is not meant to take the place of seeing duly licensed health professionals.
CLIENT RESPONSIBILITY: Our time together during Telehealth is developed for strictly educational purposes ONLY. You accept and agree that you are 100% responsible for your progress and results from the Telehealth appointment. I make no representations, warranties or guarantees verbally or in writing with respect to your health or physical or emotional progression.
With this knowledge, you voluntarily consent to the above procedures. You have had the opportunity to ask questions prior to treatment, and you understand that any further questions you have you will raise with the me, and I will answer them to the best of my knowledge, ability and training.
I am a Licensed Acupuncturist. I am not a medical doctor. I do not claim to diagnose, treat, cure or prevent any medical conditions or pathologies, nor prescribe medication, nor in any way represent myself as doing so. The services of a Licensed Acupuncturist cannot replace those of a medical doctor. For any medical condition, you are advised to seek care from an appropriate medical practitioner. Whether you choose to engage a medical practitioner or not to assist you in your care is your right, and I do not assume any responsibility for your decision in this matter.
You agree to mediate with me any dispute or claim arising between us before resorting to arbitration or court action. We will equally divide mediation fees, if any. Any disagreement not resolved by mediation shall be decided by binding arbitration, subject to the terms of my insurance carrier and any applicable law or regulation. The arbitration shall be conducted by Judicial Arbitration and Mediation Services, Inc. (JAMS). The arbitrator shall render an award in accordance with its rules. Judgment upon the award of the arbitrator(s) may be entered in any court having competent jurisdiction. The parties shall have the right to discovery in accordance with Code of Civil Procedure §1283.05. This Agreement will remain in effect until terminated by either one of us for convenience on 10 days’ notice. Any notice, request, or other communication required or permitted under these Terms and Conditions shall be in writing and shall be deemed to have been given (i) upon delivery by reputable express mail courier service providing confirmation of delivery, e.g., Federal Express; or (ii) two (2) business days after being properly deposited in the United States mail, registered or certified, return receipt requested, postage prepaid; or (iii) upon personal delivery to the recipient; or (iv) when transmitted by electronic mail (email) when directed to the email address for that recipient provided by the recipient that creates a record that is capable of retention, retrieval and review, and that may thereafter be rendered into clearly legible tangible form. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.
*East Asian Medicine is the preferred term for what was formerly known as traditional Chinese medicine or Chinese medicine (both are exclusionary to other regional practices like Korean, Japanese, Vietnamese, and French ear acupuncture).
